What can you expect from your first Family Law Appointment at Logan

You will meet with one of our experienced family lawyers at our Logan office to discuss your questions and concerns. Before attending, please make a note of your important personal information, including:

  • The date of your marriage, if you are married
  • When you started living together with your former partner or spouse
  • The names and ages of any children of the parties, and a brief summary of who they are living with and where
  • A brief summary of your income, and your former partner/spouse’s income
  • A brief summary of what you and your former partner/spouse
You can bring a support person to your appointment, who can take notes for you and support you. We do ask that your support person not speak for you or try to ask us for advice.

Our Logan Family Lawyers will go through your personal circumstances, and give you information on the pathways forward for parties seeking a separation or divorce. There are Court resource forms and information we will direct you to, and we can put you in touch with any other supports.
We can prepare a detailed fee estimate and proposal for you after your first appointment, so that you understand how family lawyers charge their fees, and how much your legal matter with us may cost. We can provide you with fee estimates for property settlements, divorce, parenting plans and any related property transactions (eg. conveyancing for selling a house, transferring the property into one person’s name, bank refinancing of joint loans, caveats to protect your interests if you are not listed on the title as an owner). If your matter is outside the scope of our firm’s services, we have trusted specialist family lawyers in Logan that we can refer you to, and we will assist you with making contact with their offices.

When will I be divorced?

Our Logan Divorce Lawyers  understand that clients who are legally married desire a divorce quickly so that they can move on. However, our clients are often surprised to hear that a divorce is not usually the first step of work in your family matter. The order of resolution is commonly: Resolving Children Matters, Resolving Property/Financial Matters and then Legal Divorce.

We often recommend not applying for a divorce until your financial and property affairs are tidied up. This is because couples who are married usually have only 12 months from the date of divorce to finalise their financial and property settlement, and this may not be achievable if parties are not co-operating. Also, your former spouse may use this deadline as a delaying tactic, and force you into having to make expensive Court applications because the deadline is approaching. For separated de facto couples, we would mention that the timeframe for you to resolve your financial and property settlement is usually two years from the date of your separation.
