Understanding the Conveyancing Process

New Client Consultation – in person or online
Meet with a solicitor to discuss your upcoming transaction, receive a scope of work and fee estimate for all expected costs – legal fees, third party fees, government charges and duties. This appointment attracts a fee of $550, including GST.
For Sellers
Advice on Seller Disclosure Obligations including property searches and due diligence.
Contract Review and Negotiation
If you are selling with an agent, we will review the draft contract they have prepared, recommend changes and assist with contract negotiations. For Buyers, we can discuss your concerns and draft special conditions to fit your circumstances. This step is crucial, as it lays the groundwork for the transaction and ensures that your interests are protected.
Contract through to Settlement
We prepare for settlement, working with your financier and you to ensure a smooth process. All government forms are prepared, searches are conducted, settlement adjustments are calculated and contract conditions are managed. For Buyers, If any issues arise during the searches or if you wish to negotiate terms, we will handle all communication and amendments to the contract on your behalf.
Settlement Day
On settlement day, we will handle the finalisation of the transaction, ensuring that all legal requirements are met and that the transfer of ownership is completed smoothly. We dedicate a stall member to watch your PEXA workspace to ensure that quick action can be taken to protect your interests (for example, if the other party un-signs the settlement very close to 4pm, attempting to force you into inadvertently breaching your obligations). We ensure the property is vacant for Buyers and ready for you to move in.
Post-Settlement Support
After settlement, we continue to provide support by ensuring that all documentation is filed correctly and that you are aware of your ongoing responsibilities under the Contract.

Queensland Property Law Has Changed - What You Need to Know
From 1 August 2025, Queensland’s new Property Law Act 2023 introduces a mandatory Seller Disclosure Framework that significantly alters the risk landscape for both Buyers and Sellers.
Key Changes:
- Mandatory Disclosure Documents must be provided before a residential property contract is signed.
- Buyers may now terminate the contract at any time before settlement if disclosure is incomplete or defective.
- After settlement, Buyers may sue for compensation if the Seller’s disclosure was misleading or inadequate.
In other words — even after settlement, the legal risks aren’t over.
This new regime creates real exposure for Sellers, and serious opportunities for Buyers to exit contracts or seek damages. And with many contracts still being prepared by non-legally qualified agents, errors and omissions are increasingly common – and costly.
When Should You Engage a Lawyer?
BEFORE signing a contract
Engaging Ryder Lawyers early — before you sign — allows us to:
- Prepare a fully compliant Seller Disclosure Statement
- Review or draft the contract of sale
- Negotiate special conditions to reflect your needs (finance, pest, building, early access etc.)
- Ensure the contract is legally accurate and enforceable
- Minimise the risk of disputes and protect you from surprise terminations
DURING a transaction – we accept very limited engagements, please contact us to discuss before sending us a contract already on foot
If you are already in a contract, we may assist urgently where:
- There is a potential breach of disclosure requirements
- One party is attempting to terminate the contract
- There is pressure to settle but questions remain about disclosure or representations
- You need clarity on rights, obligations, or timing
We work swiftly to protect your interests and prevent a small issue from becoming a legal battle.
We do not accept instructions to complete only the post-contract conveyancing steps where the Seller and Buyer have completed the Disclosure Statement process themselves or through an agent, or where a Contract has already been signed before we are engaged.
AFTER settlement
The new law doesn’t stop at settlement. If you’ve bought or sold and believe:
- You’ve received a defective Disclosure Statement
- The other party made misleading statements before or during the sale
- You’re being pursued for damages or wish to explore legal remedies
